Before instructing us to prepare a will for you, we would advise you to think of how you would like your estate to be dealt with on your death, including who you wish to benefit from your estate, as well as any family members or other people who you have a duty to provide for.

A lot of clients are unaware of the issues involved in the preparation of a will. We have to consider whether there are relationship property issues to be taken into account, whether a testamentary guardian should be appointed for a young child, or whether the person making the will has obligations to provide for certain family members in his or her will.

You should also carefully consider who you wish to appoint as your executors. The executors are the people responsible for ensuring the directions in your will are carried out properly. We aim to make the process as stress free as possible, to ensure that your will is prepared exactly to your requirements.

A significant portion of our firm's work is involved in estate administration. It's always a challenging time when a loved one passes, and seeing a lawyer is usually the last thing anyone wants to do. If a deceased person's assets exceed $15,000 at the time of their death, and they hold a will, it is usual to require a grant of Probate on their death. If a client does not hold a will at the time of their death, it is usual to require a grant of Letters of Administration for their estate. We can assist in administering an estate in both situations.
